Terms of Use

1. General provisions
1.1. These Terms of Use (the “Terms”) govern the relationship between the administration of the Nexora software (the “Administration”) and any person who uses Nexora (the “User”).
1.2. Nexora (the “Service”) is software comprising a desktop application, a server component and an official Telegram bot, which places orders on cryptocurrency exchanges according to rules set by the User, through API keys connected by the User.
1.3. By registering an account and confirming acceptance of the Terms, the User confirms having read the Terms and the Privacy Policy in the version in force at the time of registration and accepts them in full. A person who does not agree with any provision of the Terms may not use the Service.
1.4. The Service is in beta testing. The User understands that the Service may contain defects, and that its functionality and these Terms may change more often than they will after a full release.
2. Subject of the Terms
2.1. The Administration grants the User the right to use the Service to automate trading operations in the User’s exchange account on the conditions of these Terms.
2.2. The Service is not a broker, a dealer, an exchange, an investment adviser, an asset manager or a payment institution.
2.3. The Administration does not take money or cryptocurrency into custody, does not make withdrawals, and has no access to the User’s funds. The User’s funds remain in the User’s exchange account at all times.
2.4. Decisions to trade, and the choice of trading pair, strategy, its parameters and the size of trades, are made by the User alone.
3. No investment advice
3.1. No material in the Service, including strategy presets, backtest results, example settings and statistics, constitutes personal investment advice, a consultation, an offer, or a solicitation to buy or sell any asset.
3.2. Past results, including backtest results, neither guarantee nor determine future results. A backtest runs on historical data under assumptions that never fully match the conditions of a live market.
4. Risk disclosure
4.1. Trading cryptocurrency carries a high risk and may result in the partial or total loss of funds. The User should not trade with funds whose loss would be material to them.
4.2. Automated trading does not reduce market risk. The Service carries out the User’s rules without the User’s direct involvement, including while the market moves against the User.
4.3. Stopping a bot does not sell the assets it has acquired. Those assets remain in the User’s exchange account, and the decision on what to do with them rests with the User.
5. Account and security
5.1. To use the Service, the User registers an account with a valid email address and confirms it with a code sent to that address.
5.2. The User shall keep their password confidential, protect their device and the Telegram account linked to the Service, and is responsible for all actions performed using their account.
5.3. The User is strongly advised to create API keys without withdrawal permission. Keys are stored encrypted and are used solely for the trading operations assigned to bots.
5.4. The Administration, support and the project founder never request API keys, account passwords or one-time confirmation codes. Any person requesting such data is not a representative of Nexora.
6. Subscription and payment
6.1. Access to the functions of the Service is provided on a subscription basis.
6.2. The subscription is paid in Telegram Stars through the official Telegram bot of the Service, @officialnexora_bot. The Administration neither receives nor stores the User’s card details.
6.3. A subscription remains in force for the period paid for. Turning off automatic renewal keeps access until the end of the period already paid.
6.4. A payment that cannot be matched to a User account is refunded automatically.
6.5. Paying for a subscription is not an investment and bears no relation to the User’s trading results.
7. Obligations of the User
7.1. The User confirms being at least 18 years of age, and that trading cryptocurrency is neither prohibited by the law of the country where they are located nor restricted for them personally.
7.2. The User is solely responsible for paying taxes and for complying with the law of their jurisdiction.
7.3. The User shall not use the Service to manipulate a market, to circumvent exchange restrictions or for any other unlawful purpose, nor attempt to disrupt the Service or to gain access to the accounts of other Users.
8. Limitation of liability
8.1. The Service is provided “as is”, without warranty of any kind, including warranties of operability, fitness for a particular purpose, uninterrupted operation and freedom from error.
8.2. The Administration is not liable for the User’s losses, lost profits or any other damage arising in connection with the use of the Service, including as a result of: software defects and failures; delays, unavailability or inaccuracy of exchange data; interruptions to communications, power supply or the User’s device; actions of an exchange, including account restrictions and changes to rules, fees or limits; sharp market movements and absence of liquidity; strategy parameters set by the User.
8.3. The User uses the Service at their own risk and bears full responsibility for all trades made by the Service according to the User’s rules.
8.4. Nothing in this section limits liability where such limitation is not permitted by applicable law, including liability for wilful misconduct, gross negligence, and death or personal injury.
8.5. If any provision of these Terms is held invalid, the remaining provisions remain in full force.
9. Availability of the Service
9.1. The Administration does not guarantee uninterrupted operation of the Service. Bots may be interrupted by updates, maintenance, provider failures and exchange outages.
9.2. The Administration may temporarily restrict access to the Service to carry out maintenance or to address security threats.
10. Official contact channels
10.1. The official email address of the Service for enquiries is support@nexora.date. Confirmation codes, service notices and newsletters are sent from no-reply@nexora.date. The Service uses no email address outside the nexora.date domain.
10.2. The official Telegram accounts of the Service are: @officialnexora_bot, the Service’s bot; @nexorasupportq, support and partnerships; @aid66633, the project founder.
10.3. Messages in the name of Nexora sent from any other address or account are not official, and the Administration bears no responsibility for them.
11. Personal data
11.1. The User’s personal data is processed in accordance with the Privacy Policy, which forms an integral part of these Terms.
12. Changes to the Terms
12.1. The Administration may amend these Terms. The version in force and the date it was adopted are shown in the application, in the Help section.
12.2. The Administration notifies Users of material changes in the application. Continued use of the Service after a new version takes effect constitutes the User’s acceptance of it.
13. Termination
13.1. The User may stop using the Service at any time: stop their bots, revoke their API keys at the exchange, and request deletion of their account in the application settings.
13.2. The Administration may suspend or terminate the User’s access to the Service if the User breaches these Terms.
14. Dispute resolution
14.1. Disputes relating to these Terms are resolved by negotiation. Before bringing a claim to court, the User sends a written complaint to the official email address support@nexora.date, which the Administration considers within a reasonable time.
14.2. A dispute not settled by negotiation is to be resolved in accordance with applicable law.
